speeding ticket

    So, I guess it's my turn now to ask such a question here... :)

    I was going 62-63 mph on the Belt Pkwy (speed limit 50 mph) around 9pm tonight in the rain. I saw an unmarked patrol car parked on the shoulder, immediately hit the brakes and was at around 57-58 mph by the time I passed him. So, he pulled me over and said that he had clocked me at 71 mph with a laser gun. I said I was going 58 mph and asked him if he had any data to support his claim, He said he wasn't required to show any proof. He wrote me a ticket for 71 mph in a 50 mph zone, which is 6 pts and like $300.

    Cop: You have 15 days to answer this ticket blah blah blah... Do you have any questions, sir?
    Me: I hope you're happy, sir :)

    So far I've been told to plead not guilty and then postpone the court date for as long as I could. Any other advice would be appreciated. Thanks

    Idk but I heard they will look for your lights to see if you're hitting the brakes. So instead you can switch off the overdrive and that will slow you down a bit without having to pump the brakes

    I'm not in NY so not sure how easy it is to go about such things up there. Down here we have attorneys who specialize in tickets, not big money buy they make up for it in volume.
    Speeding ticket, especially if they say you were going 71 when you were going 62, I would question when they last had the machine calibrated. NY vs Struck I think says they need to use the tuning fork to calibrate the machine immediately before and after the citation was handed out.
    You could just go to the hearing and question the officer when he calibrated the machine, if he says at the beginning of the shift ask for a dismissal based on NY vs Struck. If he says he calibrated immediately before and after your traffic stop you might be screwed.

    Of course I am not an attorney and always seem to end up in jail so I don't think I would trust me.

    both my NY speeding tickets were upstate on the thruway back in 2004. i couldn't make either court appearances so i did the mail-in fine of around 170$ (74 in a 55 in Rockland county) and $210 (82 in 65 by Canajoharie).

    between 2012 and June of this year when i lived in Staten Island, i could rarely get to the speed limit on the belt parkway due to all the traffic between Verrazano and the airport exits

    I had the same exact ticket 10 years ago when I was living in Brooklyn. My court was set up at Coney Island. I searched and found the most effective lawyer. Paid him around 300 bucks or so and he killed the ticket. No points no fine.

    Lawyers and cops somehow know each other so if your lawyer knows the cop he will make sure you end up not getting the points. Again the key is finding the right lawyer who knows most of the cops in that district.

    You're on the hook for $$ regardless. You can sure try the radar calibration route, but if the cop is not dumb, you won't get a favorable answer. And it sounds like this one gives tickets for living so I wouldn't try my chances.

    Your goal is to lessen the points. Each point will become an annual surcharge for 3 years. So if you just send in $$, you'll end up paying probably about $500 every year to the great state of NY. That's on top of whatever your insurance will raise.

    The way I see it, you got 2 options.

    1. Go to court and talk to prosecutor. He will cut, typically 2 points, in exchange for a guilty plea to another violation that would carry higher fine. So instead of $300 + 6 pts, you'll be on the hook for something like $430 + 4 pts.

    2. Get a lawyer like Brook said. It'll be good $500 in NY, but you'll get a fair chance of getting off without points. The key is to find the right guy.
    Watch you mailbox. Within next 1-2 days you'll start getting mail from lawyers (I shit you not. With freedom of info act in place they have auto-alert in PD DB and know who is on the hook within minutes from the ticket). Call them and ask if the firm dealt with that specific court, and what where past results.

    IMO, you should go with #2.

    Just had my sons ticket reduced 28 MPH, he got it on the Taconic PKWY, lawyer cost $400

    Why don't you first start with your insurance agent. If you have been clean for a number of years I doubt your rate is going up given the competion among auto carriers. I was pulled over in Maryland recently but the local cop just gave me a warning after looking on his laptop and saying "Iam clean".

    In the past I just paid my fine for a speeding tic and let time roll by as this is a rare occurrence for me

    My rates were not effected by it. I think DUIs are a more serious matter

    You might also want to check with DMV if points are deleterious for license renewal

    The Belt is usually highly congested with lots of people overdoing it...that's bad/odd luck

    I had a similar ticket recently and Brooklyn is right, all of these lawyers and prosecutors know one another. Pick a traffic lawyer based near the court and they will squash it for you. It cost me $400 bucks but no points or fine and I didn't have to go to court. My criteria for selecting a lawyer was picking the hottest female one..worked out well for me. LOL

    Can you get out of the points by doing some BS online driver class like here in Florida?

    Thanks, everyone. I am gonna prolong this for as long as I can. As I learned, points apply from the time of offense, not from when you're actually convicted. So, even I am found guilty, I won't have 6 points for 18 months but rather for 18 months minus the court date (which could be over a year from now). I'll try to postpone the court date at least twice and then hire an attorney.

    Yes, but one can't take more than one in 36 months. I already took one about 2 years ago to lower my insurance premium.

    I know it's been a while since I've been back east, but I still can't imagine a highway/freeway with a 50mph speed limit. Most of ours in-city are 65 and 70-80 on the outskirts.

    New York has stupid speed limits. Fuck that state.

    I got my second ticket when I was 17. First one was a non-moving violation. Second one was racing. They wanted to slap me with 7 points and suspend my license for a month. Lawyered up and they cut me a massive break. "Unsafe Driving", $250 fine + court fees, no points, no suspension. Best $500 I ever spent.

    They pull this kinda crap all the time here (first time happened to me). At the same time I see people driving on the red light every damn day, doing some crazy U-turns, endangering everyone around, but the men in blue are nowhere to be seen.
